Tampa, FL – The Hillsborough County State Attorney’s office dismissed all charges against a Tampa defendant charged with Driving Under the Influence (DUI), on the grounds that the officer who originally pulled over the defendant did not have a   legally sufficient reason to do so.  The defendant had retained Tampa DUI attorney Jeff Rich of Mayberry/Rich, criminal defense firm in Tampa, FL, as his attorney.

 

The defendant was originally pulled over for speeding, and once pulled over was asked to perform a field sobriety test, which he failed.  He was then arrested for DUI, after the officer ran a background check and learned that the defendant already had been charged with two DUIs in the past five years.  This would have been the defendant’s third DUI in five years, which would have  carried serious penalties. Under Florida Law there is a minimum of 30 days jail the defendant must serve if convicted of a third DUI in  ten years, along with other substantial sanctions and fines.

 

After posting bond and being released from jail, the defendant retained Attorney Jeff Rich of Tampa DUI Defense Firm Mayberry/Rich. After reviewing the evidence, Attorney Rich determined that the officer who placed the defendant under arrest did not have a valid reason to stop the defendant. Attorney Rich filed a motion to suppress and set it for a hearing. On the morning of the motion hearing the State Attorney’s office chose not to challenge the motion, and dismissed all charges against the defendant.
