Tampa DUI Attorney Blog Helps Citizens Know Their Rights, Avoid DUI Charges
Florida Criminal Defense Blog Proves Valuable Resource for Tampa Citizens
May 2009, Tampa, FL – The Tampa DUI lawyers at Mayberry/Rich proved their criminal defense blog to be a useful legal resource for Tampa citizens, when one of their clients successfully avoided a DUI charge after following the advice of one of their previous blog entries. In a posting dated October 15th, 2008, Tampa DUI attorney Jason Mayberry advised readers to request the presence of an attorney before taking any field sobriety exercises if pulled over for a DUI in Florida. A visitor to this blog was recently pulled over for suspicion of driving under the influence, and after following the instructions suggested in the Mayberry/Rich blog posting, was able to retain Jason Mayberry as a DUI defense lawyer and successfully had his charges reduced from DUI to Reckless Driving.
The client, who was pulled over for weaving on the road, stated that he would consent to take any test requested of him so long as he could have his DUI lawyer present – a request that the individual is not entitled to, and will result in a license suspension and immediate DUI charge. However, in requesting an attorney an individual is not directly refusing the exercises, thus making it extremely difficult for the State to prove impairment, and ultimately the charge of Driving Under the Influence. This advice, which was outlined by the DUI attorneys at Mayberry/Rich, proved successful for this client. The client was then able to retain Jason Mayberry, who was able to get the charges reduced from a DUI to a less severe Reckless Driving charge with a withhold of adjudication – which will allow the client to immediately seal his record, and expunge it after 10 years of sealing.
